Terms & Conditions

These Terms and Conditions apply to all electrical and gas services provided by Adamson Electrical Pty Ltd. Effective 1 June 2026 — replaces all previous versions.

Part A

General Terms and Conditions

1. Definitions

In these Terms and Conditions, unless the context otherwise requires:

  • Accepted Invoice means an Invoice accepted by you in writing in accordance with Clause 4.
  • Adamson, Adamson Electrical, we, us, or our means Adamson Electrical Pty Ltd ACN 614 375 209, ABN 34 614 375 209, trading as ADAMSON, holding the licences and authorities described in Clause 3.
  • Australian Consumer Law (ACL) means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
  • CC Act means the Competition and Consumer Act 2010 (Cth). CC Act Implied Term means any term, condition, consumer guarantee, or warranty implied by or arising under the CC Act in respect of the supply of Services by Adamson to you.
  • Certificate of Testing and Compliance (CTAC) means the certificate issued by Adamson upon completion of notifiable electrical work, as required under the Electrical Safety Regulation 2013 (Qld).
  • Client, you, or your means the person, company, or entity engaging Adamson for the provision of Services.
  • Commercial Work means Services provided at or for a commercial, industrial, or non-residential premises, or for commercial or industrial purposes.
  • Completion Date means the date on which the Services are practically complete and ready for use by the Client.
  • Domestic Building Work has the meaning given to it under the Queensland Building and Construction Commission Act 1991 (Qld) (QBCC Act), and generally refers to building work performed on a residential dwelling.
  • Gas Compliance Certificate means the certificate required to be issued upon completion of gas work under the Plumbing and Drainage Act 2018 (Qld) or the Petroleum and Gas (Production and Safety) Act 2004 (Qld), as applicable.
  • Gas Work means any work on a gas installation, appliance, fitting, or pipeline that requires a gas work authority or licence under applicable Queensland legislation.
  • Invoice means a document issued by Adamson to you describing the Services and the applicable fees.
  • Parties means Adamson and you collectively. Party means either one of them.
  • Premises means the location at which the Services are to be provided, as specified in any Invoice or Accepted Invoice.
  • QBCC Act means the Queensland Building and Construction Commission Act 1991 (Qld).
  • Quote means the written or electronic estimate of the cost of Services provided by Adamson to you prior to work commencing.
  • Services means the electrical and/or gas services provided by Adamson, as described in Clause 2 and in any Invoice or Accepted Invoice.
  • Service Fee means the amount payable by you to Adamson for the Services, as specified in an Invoice or Accepted Invoice.
  • Terms means these Terms and Conditions, including all Schedules, and any applicable Invoice or Accepted Invoice.
  • Website means www.adamsonelectrical.com.au.

2. Scope of Services

Adamson Electrical provides professional electrical and gas services performed by appropriately licensed and qualified technicians in accordance with applicable industry standards, legislation, and regulations.

Electrical Services include, but are not limited to: residential electrical work (new builds, renovations, repairs, fault finding, safety inspections, switchboard upgrades, power points, lighting, ceiling fans, safety switches); commercial electrical (tenancy fit-outs, retail and office, three-phase, lighting and controls, emergency and exit lighting); industrial (factory and warehouse, motor and machine connections, industrial switchboards, control systems); construction (subdivisions, multi-residential, temporary supplies); service and maintenance (contracts, testing and tagging, thermal imaging, preventative programs); air conditioning up to 18 kW (see Schedule A); data and communications (structured cabling, CCTV, intercom, automation); utilities and infrastructure (underground services, switchboard connections, metering, street lighting).

Gas Fitting Services include, but are not limited to: residential gas fitting (internal pipework, bayonets, appliance connections, leak testing); LPG gas fitting (cylinder connections, regulators, LPG reticulation); natural gas infrastructure (line extensions and upgrades, meter installations, main connections); gas maintenance and compliance (leak detection, pressure testing, audits, servicing); gas appliance installation (cooktops, ovens, BBQs, hot water systems, heaters, commercial cooking — see Schedule B).

All Services are performed in accordance with applicable legislation including the Electrical Safety Act 2002 (Qld), Electrical Safety Regulation 2013 (Qld), Plumbing and Drainage Act 2018 (Qld), Petroleum and Gas (Production and Safety) Act 2004 (Qld), QBCC Act 1991 (Qld), Building Industry Fairness (Security of Payment) Act 2017 (Qld), AS/NZS 3000, AS/NZS 5601, the NCC, WHS Act 2011 (Qld), and the ACL.

3. Licences and Regulatory Authorities

Adamson Electrical holds the following licences and authorities:

  • QBCC Contractor Licence No. 15325851;
  • Queensland Electrical Contractor Licence No. 81640 (Electrical Safety Act 2002 (Qld));
  • Arctick Refrigerant Handling Licence No. L134638;
  • Gas Work Authority issued under applicable Queensland gas legislation.

All electrical and gas work is performed by appropriately licensed personnel. Adamson will not perform work outside the scope of its current licences and will advise the Client if specialist subcontractors are required.

4. Quotes and Pricing

A written Quote will be provided before work begins where practicable. For minor or emergency works, a verbal or electronic estimate may be confirmed in writing as soon as practicable.

Prices are based on the scope outlined in the Quote. Additional work outside the agreed scope will be communicated to and approved by the Client in writing before proceeding.

For Domestic Building Work where the contract value exceeds $3,300, a written contract will be provided in accordance with the QBCC Act and Schedule 1B.

For Commercial Work, pricing is subject to the terms of the applicable Quote or written agreement.

Quotes are valid for 30 days from issue unless otherwise stated. Adamson reserves the right to revise a Quote if site conditions, regulatory requirements, or scope change materially.

Indicative prices are based on standard installation conditions. Additional charges apply where conditions do not meet standard specifications — see the relevant Schedule.

5. Payment Terms

A minimum deposit of 20% of the contract value is required upon written acceptance of a Quote, unless otherwise specified in an applicable Schedule. Gas appliance and cooking appliance installations require 50% as set out in Schedule B.

The remaining balance is due upon completion of the Services (Completion Date), unless otherwise agreed in writing.

We accept payment by cash, bank transfer (EFT), or direct deposit. BSB: 034 230 | Account No: 443 873.

Invoices not paid within 30 days of the due date are subject to late payment fees.

For Commercial Work, payment terms will be as specified in the written Quote or contract. Progress payments may be required for larger projects.

Failure to Pay: Payment is due no later than the Completion Date. Payments made after this date without a prior written arrangement constitute a breach of contract. All debt recovery costs — including legal fees — are the Client's responsibility.

Adamson reserves the right to suspend Services if payment obligations are not met and may refer overdue accounts to QCAT or a debt collection agency without further notice.

6. Deposit and Refunds

Deposits are non-refundable after the expiry of any applicable cooling-off period, or once preparatory work or material procurement has commenced.

In the event of cancellation, work completed beyond the deposit amount remains payable by the Client.

If Adamson cancels through no fault of the Client, Adamson will refund any deposit paid for work not yet commenced.

For Domestic Building Work, deposit amounts are subject to the maximum deposit limits prescribed under the QBCC Act. Refer to www.qbcc.qld.gov.au for current applicable limits.

7. Cooling Off Period

For Domestic Building Work regulated under Schedule 1B of the QBCC Act, the Client has the right to withdraw from the contract during a cooling-off period of 5 business days, commencing when the Client has received a signed copy of the entire contract (including any plans and specifications).

To withdraw, the Client must provide Adamson with a signed written notice of withdrawal under section 35 of Schedule 1B of the QBCC Act (see section 37 for the full procedure).

The cooling-off period applies only to Domestic Building Work contracts. It does not apply to Commercial Work, service and maintenance engagements, or emergency works.

Nothing in these Terms limits any additional rights the Client may have under the Australian Consumer Law.

8. Client Obligations

The Client must:

  • Before commencement, advise Adamson of any known or suspected hazardous materials including asbestos and lead paint;
  • Before Gas Work, confirm location and accessibility of gas meters, isolation valves, and existing gas infrastructure;
  • Ensure all necessary permits, Development Approvals, owner consents, and body corporate approvals are obtained prior to commencement;
  • Ensure any preliminary works are completed at the Client's cost before the agreed commencement date;
  • Ensure the Premises has adequate electrical (and gas, where applicable) supply connected at the point of installation;
  • Ensure the Premises is safe, accessible, and free from hazardous materials or obstructions;
  • Ensure an authorised adult is present on the Premises throughout the duration of the Services;
  • Provide accurate information regarding the Premises and existing infrastructure, including disclosure of any known non-compliant work;
  • Following completion, maintain, service, and use all installed systems and equipment per manufacturer specifications.

9. Site Access

The Client must ensure safe and unobstructed access to the Premises for Adamson's personnel throughout the duration of the Services.

This includes providing necessary permissions, removing obstacles, and maintaining a safe working environment in accordance with the Work Health and Safety Act 2011 (Qld).

Any delays or additional costs incurred as a result of restricted or unsafe access are the Client's responsibility.

Adamson reserves the right to refuse to commence or continue Services where site conditions pose a health or safety risk, and will notify the Client accordingly.

10. Cancellation and Rescheduling

The Client must provide at least 24 hours' written notice to cancel or reschedule a scheduled appointment.

A cancellation or rescheduling fee of $150 plus GST will be charged where: (i) the Client cancels or reschedules without the required notice; (ii) the Client is not present at the scheduled time; or (iii) Adamson's technician attends site, identifies additional requirements, and the Client subsequently cancels.

Either Party may cancel with written notice. Deposits are non-refundable after any applicable cooling-off period; work completed beyond the deposit amount remains payable; if Adamson cancels for reasons other than Client breach, any unused deposit is refunded.

For contracted commercial clients, if the Client cancels (other than due to Adamson's default), Adamson is entitled to 20% of the remaining contract value as compensation, plus payment for all work completed.

Cancellation fees do not apply during the QBCC Act statutory cooling-off period for Domestic Building Work (see Clause 7).

11. No-Show Fee

Clients are expected to be present at the Premises at the scheduled appointment time.

Failure to be present without prior notice will result in a no-show fee of $150 plus GST.

12. Delays

Unforeseen circumstances beyond Adamson's reasonable control — including adverse weather, supply chain disruptions, regulatory delays, or other force majeure events — may cause delays. Adamson will notify the Client promptly and provide an updated schedule.

Delays caused by events outside Adamson's control do not constitute a breach of contract. The Client agrees to allow reasonable additional time to complete the Services.

Any additional costs from delays outside Adamson's control are subject to written agreement between the Parties.

If a delay is caused by Adamson's default, Adamson will work with the Client to provide appropriate compensation, documented in writing.

13. Subcontracting

Adamson may, at its sole discretion, subcontract the performance of all or part of the Services to appropriately licensed and qualified third-party contractors.

Adamson remains responsible for the quality and regulatory compliance of all work performed by its subcontractors and will ensure all subcontractors hold required licences.

14. Compliance Certificates and Regulatory Notifications

Electrical Work: Upon completion of notifiable electrical work, Adamson will issue a Certificate of Testing and Compliance (CTAC) as required under the Electrical Safety Regulation 2013 (Qld), and make required notifications to ESQ within prescribed timeframes.

Gas Work: Upon completion, Adamson will issue a Gas Compliance Certificate and lodge any required regulatory notifications in accordance with the Plumbing and Drainage Act 2018 (Qld) or the Petroleum and Gas (Production and Safety) Act 2004 (Qld).

Regulatory Inspections: Adamson will cooperate fully with any required regulatory inspections and will notify the Client of inspection requirements, schedules, and outcomes.

Building Approvals: Where Services require a Development Approval or Building Permit under Queensland law, it is the Client's responsibility to obtain such approval prior to commencement, unless otherwise agreed in writing.

Non-Compliant Infrastructure: If Adamson identifies existing electrical or gas infrastructure that does not comply with current standards, Adamson will advise the Client in writing and may decline to connect new equipment or extend existing systems until the non-compliance is rectified at the Client's cost.

Gas Leak Protocol: If a gas leak is detected, Adamson will immediately isolate the gas supply; notify the Client and emergency services if required; not recommence work until the leak is safely rectified; and provide a written incident report. Rectification costs for leaks not caused by Adamson's work are the Client's responsibility.

15. Warranty

Adamson offers a two-year warranty on labour for all Services, covering defects in workmanship or installation errors directly attributable to Adamson.

For Domestic Building Work regulated under the QBCC Act, statutory warranty periods from the Completion Date are: defective work — 1 year; structural defects — 6 years and 6 months. Where Adamson's two-year labour warranty is more favourable, it applies. Nothing in this clause limits QBCC statutory warranty rights.

Warranty claims must be submitted in writing within the applicable warranty period. Adamson will assess and respond within a reasonable time.

The warranty does not cover materials or equipment, which are subject to manufacturer warranties.

The warranty does not cover damage from misuse, neglect, or failure to follow instructions; modifications by the Client or third parties post-Completion; normal wear and tear; or damage from events outside Adamson's control.

16. Limitation of Liability

Adamson acknowledges that the Australian Consumer Law may grant the Client non-excludable rights, guarantees, and remedies (Non-Excludable Rights). Nothing in these Terms excludes, restricts, or modifies any Non-Excludable Rights.

Subject to Non-Excludable Rights: Adamson excludes all other implied terms; and to the extent permitted by law, Adamson's liability is limited to the cost of re-supplying the Services.

No Party is liable for indirect, consequential, special, economic, or punitive damages, including lost revenues, profits, business, goodwill, or anticipated savings.

Adamson is not liable for damages resulting from misuse or failure to follow instructions; work by other contractors; pre-existing non-compliant infrastructure; or designs/specifications prepared by the Client or owner.

Adamson may suspend Services where safety conditions are unsafe, without liability to the Client.

Any claim against Adamson shall be limited to the amount paid for the specific Services giving rise to the claim.

Unfair Contract Terms: These Terms are intended to comply with the unfair contract terms provisions of the Australian Consumer Law (as amended November 2023). If any term is found to be unfair, it is severed and the remainder continues in full force.

17. Insurance

Adamson maintains Public Liability Insurance; Workers' Compensation Insurance in accordance with the Workers' Compensation and Rehabilitation Act 2003 (Qld); and QBCC Home Warranty Insurance where required for Domestic Building Work under the QBCC Act.

Certificates of currency are available upon written request.

The Client is responsible for maintaining appropriate insurance over the Premises and contents. Adamson is not liable for Client property loss or damage not directly caused by Adamson's negligence.

18. Confidentiality

Both Parties agree to keep all project details, pricing, and commercially sensitive information confidential and not disclose it to third parties without prior written consent.

This obligation does not apply to information required to be disclosed by law, court order, or information already publicly available through no fault of the disclosing Party.

19. Privacy

Adamson has adopted the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). The APPs govern how we collect, use, disclose, store, secure, and dispose of Personal Information. A copy is available at www.oaic.gov.au.

Adamson will not disclose your personal information to third parties without consent, except as required by law or necessary to perform the Services.

20. Feedback and Complaints

Adamson welcomes feedback and is committed to continuous improvement.

Complaints should be directed to contact@adamsonelectrical.com.au or 0422 990 366. Adamson will acknowledge within 2 business days and respond substantively within 10 business days.

If a complaint cannot be resolved directly, the Client may escalate to: the QBCC (www.qbcc.qld.gov.au); the Office of Fair Trading Queensland (www.qld.gov.au/fairtrading); the Electrical Safety Office (ESO); or QCAT for payment and service disputes.

21. Governing Law

These Terms are governed by the laws of Queensland, Australia. Both Parties submit to the non-exclusive jurisdiction of the courts of Queensland.

22. General Provisions

These Terms may be updated by Adamson from time to time. For regulated QBCC contracts, updates will be communicated as required by the QBCC Act. Continued engagement following notification of updates constitutes acceptance.

If any provision is void, unenforceable, or illegal, it is severed. The remaining Terms continue in full force.

A Party's failure to exercise a right under these Terms is not a waiver of that right.

You may not assign rights or obligations without Adamson's prior written consent. Adamson may assign to a related entity or business purchaser without your consent.

Electronic acceptance of a Quote — by email, text, or online link — constitutes a legally binding agreement and is accepted as a valid form of signature.

These Terms constitute the entire agreement between the Parties and supersede all prior representations, negotiations, and agreements.

Schedule A

Air Conditioning Services

A1. Standard Installation

Standard installation price applies to a 'back-to-back' split system installation including: up to 3 metres of copper piping; up to 15 metres of electrical cabling; up to 2 metres of capping or conduit.

Standard pricing applies to premises that are single-storey, not double brick or concrete, have no asbestos present, and are within 25 km of Adamson's operational base. Strata/apartment installations require prior agreement.

Non-standard requirements will be communicated on-site before work proceeds. Additional charges apply.

A2. Unit Placement

Unit placement must be finalised on-site with an authorised person. Placement will be documented in writing with a photograph, and the Client will sign a job completion form.

Any adjustments after the initial installation date will be treated as a new service with additional charges.

A3. Refrigerants

All refrigerant work is performed under Arctick Licence No. L134638 in accordance with the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989 (Cth).

Adamson will not perform work requiring the illegal venting of refrigerants.

A4. Conditions for Installation

The installation cannot proceed if: health and safety risks exist (including asbestos); there is material disagreement on pricing; the Client or any person present is abusive or aggressive; or the premises does not meet standard installation conditions.

If Adamson elects not to proceed, any deposit paid will be refunded per Clause 6.

A5. Post-Installation Responsibility

The Client is responsible for ongoing maintenance and servicing per manufacturer specifications.

Where Adamson investigates a reported fault and determines it is not an installation error, Adamson may charge the Client for investigation and callout costs.

Schedule B

Gas Appliance & Cooking Appliance Installation

B1. Scope

This Schedule applies to the installation of gas cooking appliances, gas hot water systems, gas heaters, BBQ bayonets, and related gas appliances, whether supplied by the Client or by Adamson.

B2. Standard Installation Conditions

Indicative pricing applies to 'like-for-like' replacements only. New installations or gas infrastructure modifications incur additional charges.

Existing gas supply must comply with current regulations including AS/NZS 5601. Non-compliant infrastructure must be rectified before connection.

New appliances must fit within existing cabinetry. Cabinetry modifications are the Client's responsibility and must be completed before the installation date.

Existing electrical circuits must comply with current regulations including appropriate cable sizing and RCD protection.

B3. Payment for Appliance Installation

A minimum deposit of 50% is required upon booking.

Full payment for Adamson-supplied materials is required prior to installation.

Remaining balance is due upon completion on the installation day.

B4. Client Obligations

In addition to Clause 8 of Part A, the Client must ensure:

  • Adamson is notified of any known or suspected asbestos prior to installation;
  • Client-supplied appliances are new, unused, and in original packaging at time of installation;
  • The Client owns the appliance free from encumbrances;
  • Gas and electrical supply is connected, compliant, and accessible at the installation point;
  • Required plumbing, electrical, or carpentry works have been completed prior to the installation date, at the Client's cost.

B5. Gas Compliance

Adamson will issue a Gas Compliance Certificate and lodge required notifications in accordance with Clause 14 of Part A.

If non-compliant gas infrastructure is identified during installation, Adamson will not connect a new appliance without the Client's written acknowledgement and authorisation to rectify the non-compliance first.

B6. Acknowledgement Regarding Appliance Sale

Unless otherwise agreed in writing, Adamson is providing installation Services only and has not sold the appliance. Adamson's warranty and liability extend to installation work only.

Schedule C

Commercial and Industrial Work

C1. Application

This Schedule applies to all Services at commercial, industrial, or non-residential premises, including fit-outs, industrial installations, construction projects, and utilities and infrastructure work.

The QBCC Act domestic building provisions (Clause 7 cooling-off and Clause 15(b) statutory warranty) do not apply to Commercial Work. The warranty for Commercial Work is Adamson's two-year labour warranty under Clause 15(a) only, unless otherwise agreed in writing.

C2. Quotes and Contracts

For Commercial Work exceeding $10,000, Adamson will provide a written scope of works and pricing schedule before commencement.

Ongoing service and maintenance contracts will be documented in a separate written agreement, which supplements these Terms for that subject matter.

C3. Payment

Payment terms will be as specified in the written Quote or contract. Progress payments based on milestones may be required for larger projects.

Late payment of commercial invoices may attract interest at 10% per annum, calculated daily from the due date.

The Building Industry Fairness (Security of Payment) Act 2017 (Qld) (BIF Act) may apply to commercial construction contracts. Nothing in these Terms limits any payment claim rights or adjudication rights under the BIF Act.

C4. Compliance

For commercial and industrial work, Adamson will comply with all applicable Australian Standards, the National Construction Code, and any industry-specific regulatory requirements.

The Client is responsible for obtaining all required Development Approvals, Building Permits, and authority connections before work commences, unless otherwise agreed in writing.

For industrial electrical work including high-voltage or complex control systems, Adamson will confirm in writing whether the work falls within its current licence scope before commencing.

Acceptance of Terms and Conditions

By engaging Adamson Electrical Pty Ltd — whether by signing a contract, accepting a Quote electronically (email, text, or online link), or by permitting work to commence — you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and all applicable Schedules.

These Terms and Conditions are a general commercial document. Adamson Electrical recommends obtaining independent legal advice before using this document for high-value or complex contracts.
